SERVICE PROVIDER

BALAI provides pre-screened and highly qualified personnel on contractual basis, saving you cost on advertising and the process of recruiting and screening of said personnel. APO guarantees that no employer-employee relations shall exist between the company and out contractual personnel. In case your require the contractor’s personnel to render services beyond the normal work schedule, the overtime rate per hour shall be in accordance with the accompanying cost breakdown. Overtime authorization shall be issued by the concerned department head of the company for extra services and emergency jobs rendered by the contractor’s personnel. Relievers / replacement shall be made available to ensure continuous and uninterrupted services in case of absence of our workers.

LABOR RELATIONS

BALAI provides labor relations consultancy services to promote industrial peace within the company. As part of these services, we will assist in settling labor disputes, provide advice on strategies on collective bargaining negotiations and/or offer suggestions relative to possible labor concerns such as formation of labor- management productivity committees.

QUALIFICATIONS

Our service personnel shall be provided with the proper company uniform (case to case basis) and identification cards. We provide our client with quality service personnel who have been extensively screened and trained under the supervision of skilled trainers, and therefore qualified in all facets of behavioral and technical efficiency.

QUALITY ASSURANCE

During the performance of duties by our service personnel, we shall maintain effective management for efficiency and discipline. We advise your company to report to us acts of disobedience, misconduct, negligence, disrespect and other ungainful acts of our service personnel for the imposition of disciplinary actions. We have a team of counselors who randomly check the performance and attendance of our service personnel. This way the quality of our service can be maintained at the desired standard.

ACCOUNTABILITY

In our effort to give you quality service, we are directly liable for any reasonable damage or injury solely caused by our personnel to your company or employees. It is our policy to maintain a non-employer-employee relationship between your company and the assigned service personnel. All service personnel are considered as our employees and therefore, we are directly taking the responsibility for claims to personnel injury, wages, employment benefits, damages including death caused to the said employee or any third party, whether or not such injury or death arises in the course of, or in connection with the performance of duties of the employees. In the event of a suit against you arising from any claim that your company is in effect the direct employer of any of our employees, we shall give you our utmost support and assistance in defending our service agreement establishing the relation of principal and independent contractor, and we shall hold you free and harmless from any liability arising therefrom. You shall have the right to search our personnel before they enter and leave your premises as a precautionary measure against property losses. Our company is a duly licensed contractor with substantial capital to carry out our operations and obligations stated herein.

MODE OF PAYMENT

In as much as the dominant part of this contract goes to our personnel in the form of salaries, payment of the contract amount is of the essence and such shall be due and demandable every 10th and 25th of the month.

ESCALATION CLAUSE

Should there be any executive orders or mandatory legislation providing for an increase in salaries. allowances and other benefits, the contract shall be adjusted proportionately after formal negotiations.

TERMS OF CONTRACT

The contract shall be valid for one (1) year from the date of signing and shall be renewable at the option of both parties. Either party may terminate this contract by written notice not less than thirty (30) days prior to the intended date of termination.
